Terms of Service

These Terms of Service (“Terms”) govern your use of SendMystery (“SendMystery,” “we,” “us,” or “our”), a sole proprietorship operated by Seid-Puya Seid-Karbasi, and the website at sendmystery.com (the “Site”). By placing an order or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What SendMystery is

SendMystery is a curated gifting service. You (the “Sender”) answer a short questionnaire about a recipient and pay a flat price. Our team then hand-selects a physical gift based on your answers and ships it to the recipient. You do not choose the specific item — the surprise is a core part of the experience. Neither you nor the recipient knows what the gift is until the recipient opens it.

2. Eligibility

• You must be at least 18 years old to place an order.
• We currently ship only to addresses within the United States. Orders for delivery outside the US cannot be fulfilled.
• You are responsible for providing accurate sender and recipient information, including a valid shipping address.

3. Orders, pricing & payment

• Gifts are offered at flat price tiers (currently $60, $100, $150, and $350). The price you pay is shown at checkout before you confirm.
• Payment is collected in full at the time of purchase through our payment processor, Stripe. We do not store your full card details.
• Value guarantee: we intend the retail value of each gift to exceed the price you paid. This is our curation standard, not a cash-value guarantee, and does not entitle you to a specific item or appraisal.
• All orders are one-time purchases. SendMystery is not a subscription and does not automatically re-bill you.

4. The mystery experience

Because the value of SendMystery is the surprise, you acknowledge and agree that: (a) you will not be told what the gift is before or after purchase; (b) gift contents are selected at our discretion based on your answers; and (c) the specific item, brand, and appearance may vary. If the recipient reveals the gift through our reveal flow, we may share their reaction (a photo and/or message they choose to submit) with you.

5. Cancellations & changes

Once curation has begun, an order generally cannot be canceled or changed, because we may have already purchased and prepared the gift. If you need to correct a shipping address or cancel, contact us as soon as possible and we will help where we can. See our Refund Policy for details on refunds.

6. Shipping & delivery

We ship to the US address you (or the recipient) provide. Estimated delivery times are provided in good faith but are not guaranteed. Title and risk of loss pass upon delivery to the carrier. If a package is lost or damaged in transit, contact us and we will work with you to make it right (see Refund Policy).

7. Address collection from recipients

If you do not know the recipient’s address, we may email the recipient a secure link to provide it. We use this information solely to ship the gift. See our Privacy Policy.

8. Referral codes & promotions

We may issue referral or promotional codes (for example, a discount when a recipient sends their own gift). Codes have no cash value, may be limited to one use, may expire, and may be modified or discontinued at any time.

9. Acceptable use

You agree not to use SendMystery to harass, deceive, or harm anyone; to send gifts to unwilling recipients; to submit unlawful, infringing, or abusive content (including in notes or reveal messages); or to interfere with the Site’s operation or security. We may refuse, cancel, or refund any order at our discretion.

10. User content

Notes, quiz answers, reveal messages, and photos you or a recipient submit are “User Content.” You represent that you have the right to submit it. You grant us a limited license to use User Content to operate the service (for example, printing a note on a card, or sharing a recipient’s reaction with the sender). We may remove content that violates these Terms.

11. Intellectual property

The Site, brand, logo, and content are owned by SendMystery and protected by law. You may not copy, reproduce, or use them without our permission.

12. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a gift will meet a recipient’s subjective preferences.

13. Limitation of liability

To the fullest extent permitted by law, SendMystery’s total liability for any claim arising out of or relating to an order or these Terms will not exceed the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages.

14. Indemnification

You agree to indemnify and hold SendMystery harmless from claims arising out of your use of the service, your User Content, or your violation of these Terms.

15. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Orange County, California, and you consent to that jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the current version. Continued use after changes means you accept them.
